Food Establishments

Food establishments are any operation that stores, prepares, packages, serves, vends or otherwise provides food for human consumption including restaurants; satellite or catered feeding locations; catering operations if the operation provides food directly to the consumer or to a conveyance used to transport people; market; vending location; conveyance used to transport people; institution; or food bank; and that relinquishes possession of food to a consumer directly, or indirectly through a delivery service such as home delivery of grocery orders or restaurant takeout orders, or delivery service that is provided by common carriers.

Establishments operating in Gilmer County meeting this definition require permitting and compliance regulation from Gilmer County Health Department.

Food establishments in West Virginia are regulated under theĀ 2013 FDA Food Code as adopted by the state under W.V. 64 C.S.R. 17 Food Establishments which details some changes to the model law.
